Terms and Conditions

These Website Terms and Conditions (“Terms”) govern access to and use of the website located at https://shongum.org (the “Website”), which is operated by Shongum Sportsmen’s Association (“Shongum,” “SSA,” “we,” “us,” or “our”).

Please read these Terms carefully before using the Website.

By accessing or using the Website, creating or using a member account, submitting information or content, registering for an event, or making a payment through the Website, you agree to these Terms to the extent applicable to your use of the Website.

If you do not agree to these Terms, you should not use those portions of the Website requiring acceptance of them.

1. Purpose of the Website

The Website provides information and online services relating to Shongum Sportsmen’s Association, including:

  • Information about the Association and its activities
  • Membership information and administration
  • Member account access
  • Member directories and profiles
  • Club announcements and communications
  • Calendars and event information
  • Event registration
  • Online payments
  • Forums and other member communications
  • Photographs, documents, and other club-related materials
  • Contact and inquiry forms
  • Other services made available by Shongum from time to time

Some portions of the Website are available to the general public. Other portions are restricted to members or other authorized users.

2. Relationship to Other Shongum Rules and Policies

These Terms govern use of the Website and related online services.

They do not replace, amend, or supersede Shongum’s:

  • Certificate of Incorporation
  • Constitution or Bylaws
  • Membership requirements
  • Range rules
  • Safety rules
  • Guest rules
  • Event or competition rules
  • Liability waivers
  • Codes of conduct
  • Disciplinary procedures
  • Committee rules or procedures
  • Other formally adopted Association policies

Membership in Shongum and participation in Association activities may be subject to additional requirements regardless of whether those requirements appear on the Website.

If a conflict exists between these Website Terms and a formally adopted Association governing document concerning membership, club governance, range operations, safety, or participation in Association activities, the applicable Association governing document or specific policy will control with respect to that subject.

3. Eligibility and Website Access

Public portions of the Website may generally be accessed by visitors.

Certain features are restricted to Shongum members, applicants, event participants, administrators, or other authorized users.

All Shongum members are required to maintain a member account as part of the Association’s membership administration system.

Access to restricted portions of the Website is a privilege associated with authorization by the Association and does not create an independent contractual right to continued Website access.

Shongum may establish, modify, restrict, suspend, or discontinue access to particular Website functions at any time.

4. Member Accounts

Members and other authorized users may be provided with individual Website accounts.

You are responsible for:

  • Providing accurate and current account information
  • Maintaining the confidentiality of your username and password
  • Using a secure password
  • Preventing unauthorized use of your account
  • Promptly updating inaccurate or outdated information
  • Promptly notifying Shongum if you believe your account has been compromised

You may not:

  • Share your login credentials with another person
  • Allow another person to use your account
  • Access another person’s account without authorization
  • Attempt to obtain another user’s password
  • Circumvent access restrictions
  • Falsely represent your identity or membership status

Activity performed through your account may be treated as activity performed by you unless Shongum has reason to believe the account has been compromised.

Shongum may reset credentials, restrict access, or suspend an account when reasonably necessary to protect the Website, the Association, its members, or other users.

5. Member Directory and Member Information

The Website may include a member directory, member profiles, contact information, or similar membership information.

Access to such information is provided solely for legitimate Association and member-related purposes.

Users may not use information obtained through the Website to:

  • Create or compile unauthorized mailing lists or databases
  • Conduct unsolicited commercial marketing
  • Sell or distribute member information
  • Harvest email addresses, telephone numbers, or other contact information
  • Send spam or mass solicitations unrelated to Association business
  • Harass or intimidate another person
  • Publish member information outside the Website without authorization
  • Use information for fraudulent or unlawful purposes

The availability of information within a member-only portion of the Website does not make that information public.

Use and disclosure of personal information are also governed by Shongum’s Privacy Policy.

6. Acceptable Use

You agree to use the Website lawfully and in a manner consistent with its intended purpose.

You may not use the Website to:

  • Violate any applicable law or regulation
  • Violate another person’s legal rights
  • Impersonate another person or organization
  • Submit false or misleading information
  • Engage in fraud or attempted fraud
  • Harass, threaten, intimidate, or abuse another person
  • Publish defamatory or unlawfully discriminatory material
  • Distribute obscene or unlawful material
  • Infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual-property rights
  • Upload malware, malicious code, corrupted files, or other harmful material
  • Attempt unauthorized access to accounts, systems, servers, databases, or networks
  • Probe, scan, or test Website security without authorization
  • Interfere with Website operation or availability
  • Circumvent technical or access-control measures
  • Scrape, crawl, harvest, or systematically extract Website or member data without authorization
  • Send spam or unauthorized bulk communications
  • Use the Website primarily for unauthorized commercial purposes
  • Engage in conduct that materially disrupts the Website or its users

Shongum may determine, in its reasonable discretion, whether particular Website activity violates these Terms.

7. Forums, Posts, Classifieds, and Other Member Content

The Website may permit users to post or submit:

  • Forum messages
  • Comments
  • Photographs
  • Videos
  • Classified advertisements
  • Documents
  • Event reports
  • Messages
  • Suggestions
  • Other content

Users are responsible for the content they submit.

You may not submit content that:

  • You do not own or have permission to use
  • Violates another person’s copyright, trademark, privacy, publicity, or contractual rights
  • Is defamatory or unlawfully threatening
  • Is fraudulent or intentionally misleading
  • Contains malicious software or code
  • Violates applicable law
  • Reveals confidential personal information without authorization
  • Is unrelated to the legitimate purpose of the applicable Website feature
  • Materially interferes with the Website or Association activities

Shongum is not obligated to monitor all submitted content but reserves the right to review, moderate, edit, relocate, restrict, archive, or remove content at its discretion.

8. Ownership of Submitted Content

Except for personal information governed by Shongum’s Privacy Policy and materials owned by third parties, content voluntarily submitted, posted, uploaded, transmitted, or otherwise provided through the Website becomes the property of Shongum Sportsmen’s Association to the fullest extent permitted by law.

By submitting content, you assign to Shongum all transferable right, title, and interest in that content, including applicable intellectual-property rights.

To the extent that any right cannot legally be assigned, you grant Shongum a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to:

  • Use
  • Copy
  • Reproduce
  • Edit
  • Modify
  • Adapt
  • Publish
  • Display
  • Distribute
  • Archive
  • Create derivative works from

the submitted content for lawful Association purposes.

These purposes may include:

  • Website content
  • Newsletters and Association publications
  • Historical records and archives
  • Event reports
  • Club communications
  • Educational materials
  • Publicity and promotion of Association activities

By submitting content, you represent that you own the content or otherwise have sufficient permission and authority to submit it and grant the rights described above.

You also represent that Shongum’s authorized use of the content will not unlawfully violate another person’s rights.

This provision does not give Shongum ownership of personal information itself. Personal information remains subject to Shongum’s Privacy Policy.

9. Shongum Content and Intellectual Property

Unless otherwise stated, Website content provided by Shongum, including text, photographs, graphics, logos, designs, documents, publications, and other materials, is owned by Shongum Sportsmen’s Association or used with permission.

The name Shongum Sportsmen’s Association, Association logos, identifying graphics, and other marks may not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization by Shongum.

Website materials may be viewed, downloaded, or printed for personal, noncommercial, or legitimate Association purposes unless otherwise restricted.

Website materials may not be reproduced, republished, sold, commercially exploited, or distributed outside their intended use without authorization when such use would infringe Shongum’s or another party’s rights.

10. Event Information and Registration

The Website may permit registration for Association meetings, competitions, training programs, orientations, social activities, and other events.

Event registration may be subject to additional requirements, including:

  • Eligibility requirements
  • Membership requirements
  • Age restrictions
  • Registration deadlines
  • Capacity limits
  • Fees
  • Safety requirements
  • Certifications or qualifications
  • Waivers or releases
  • Event-specific rules
  • Cancellation or refund provisions

Registering through the Website does not waive any such requirements.

An online registration does not guarantee participation if eligibility requirements are not satisfied or if an event is canceled, rescheduled, modified, or subject to participation limits.

Shongum may correct registration errors and may reject or cancel a registration when reasonably necessary, including where eligibility requirements have not been met.

11. Event Changes and Cancellations

Event dates, times, locations, instructors, match formats, schedules, capacity, and other details may change.

Shongum may modify, postpone, relocate, or cancel an event because of:

  • Weather
  • Range or facility conditions
  • Safety concerns
  • Instructor or organizer availability
  • Insufficient participation
  • Equipment or facility problems
  • Governmental restrictions
  • Emergencies
  • Other circumstances affecting safe or practical operation

Shongum will make reasonable efforts to communicate material changes through the Website, email, or other appropriate channels.

Users remain responsible for checking relevant event information before attending.

12. Online Payments

The Website may accept payment for:

  • Membership dues
  • Membership-related fees
  • Event registrations
  • Training programs
  • Donations
  • Merchandise
  • Other Association charges

Payments may be processed by third-party payment processors integrated with the WildApricot platform.

Shongum does not store complete credit card numbers or card security codes on its own systems.

You agree to provide accurate payment information and represent that you are authorized to use the payment method provided.

Submission of a payment does not necessarily establish eligibility for membership, an event, or another Association service where separate eligibility requirements apply.

13. Fees, Cancellations, and Refunds

Membership fees, event fees, and other charges are subject to the applicable Shongum policies and any terms stated at the time of registration or payment.

Refund eligibility may vary depending on the nature of the payment or event.

Where a specific refund, cancellation, or credit policy is displayed in connection with an event or transaction, that policy will govern that transaction.

Unless otherwise required by law, the mere inability or failure of a registrant to attend an event does not automatically establish a right to a refund.

Payment-processing fees or other nonrecoverable costs may be excluded from refunds when permitted by applicable policy and law.

14. Donations

If donations are accepted through the Website, Shongum will provide appropriate transaction documentation.

Nothing on the Website constitutes tax or legal advice regarding the deductibility of a contribution. Donors should consult their own tax advisers regarding their individual circumstances.

15. Information About Firearms, Shooting Sports, and Other Activities

The Website may contain information concerning firearms, shooting sports, competitions, training, hunting, range activities, equipment, safety practices, or other Association activities.

Such Website content is provided for general informational and organizational purposes.

Website content is not a substitute for:

  • Qualified instruction
  • Applicable law
  • Manufacturer instructions
  • Range commands
  • Event-specific safety procedures
  • Shongum range rules
  • Applicable Association policies

Anyone participating in an Association activity is responsible for following all applicable laws, safety requirements, range rules, event rules, and instructions from authorized personnel.

Nothing contained on the Website authorizes conduct that would otherwise violate law or Association rules.

16. Accuracy of Website Information

Shongum makes reasonable efforts to provide useful and accurate information but does not warrant that all Website information will always be:

  • Complete
  • Current
  • Error-free
  • Available
  • Applicable to every circumstance

Website information may occasionally contain typographical errors, outdated information, incorrect dates, broken links, or other inaccuracies.

Shongum may correct or update Website information without notice.

Where important operational information is involved, including event schedules, range availability, safety requirements, fees, or deadlines, users should consult the most current official Association information.

17. Third-Party Websites and Services

The Website may contain links to or integrations with third-party services, including:

  • WildApricot
  • Payment processors
  • Mapping services
  • Social-media services
  • External organizations
  • Vendors
  • Government websites
  • Shooting-sports organizations
  • Other third-party resources

Such links are provided for convenience or informational purposes.

Shongum does not control and is not responsible for third-party websites, services, content, availability, security, privacy practices, or terms.

A link to a third-party resource does not necessarily constitute Shongum’s endorsement of that resource.

Use of third-party services may be governed by separate terms and privacy policies established by those third parties.

18. WildApricot Platform

The Website is built on and hosted using the WildApricot membership-management platform.

Certain Website functionality, including member accounts, membership management, event registration, communications, and payment integrations, depends upon WildApricot and other third-party systems.

Availability and operation of such functions may therefore depend partly upon systems that are not under Shongum’s direct control.

Use of WildApricot-provided functionality may also be subject to applicable WildApricot terms and policies.

19. Privacy

Use of the Website is also subject to the Shongum Sportsmen’s Association Privacy Policy, which explains how information is collected, used, disclosed, retained, and protected.

The Privacy Policy is incorporated into these Terms by reference.

20. Electronic Communications

By providing an email address or using the Website, you acknowledge that Shongum may communicate electronically regarding matters such as:

  • Membership administration
  • Account information
  • Payments
  • Event registration
  • Meetings
  • Elections
  • Safety matters
  • Policy changes
  • Association operations

Certain administrative communications may be necessary for membership or participation and may not be optional.

Optional communications may be subject to separate subscription or opt-out mechanisms.

21. Account Suspension and Termination

Shongum may restrict, suspend, or terminate Website access when reasonably necessary because of:

  • Unauthorized account use
  • Security concerns
  • Violation of these Terms
  • Misuse of Website features
  • Loss or suspension of membership
  • Fraud or attempted fraud
  • Harassment or abusive conduct

Website account suspension or termination does not itself determine a person’s membership status unless action has also been taken under applicable Association membership procedures.

Similarly, suspension, termination, expiration, or other loss of membership may result in loss of access to member-only Website features.

22. Website Availability

Shongum does not guarantee uninterrupted access to the Website.

The Website or particular features may become temporarily unavailable because of:

  • Maintenance
  • Software updates
  • Internet or network failures
  • Hosting problems
  • Third-party service interruptions
  • Cybersecurity incidents
  • Equipment failures
  • Events beyond Shongum’s reasonable control

Shongum may modify, replace, suspend, or discontinue Website features without guaranteeing continued availability of any particular function.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

Shongum makes no warranty, express or implied, regarding:

  • Continuous Website availability
  • Accuracy or completeness of Website content
  • Freedom from errors or interruptions
  • Compatibility with every device or browser
  • Security against every possible threat
  • Third-party websites or services
  • Fitness of Website information for a particular purpose

Nothing in this section excludes any warranty or right that cannot legally be excluded.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Shongum Sportsmen’s Association and its officers, directors, committee members, volunteers, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Website.

This includes, where permitted by law, damages resulting from:

  • Website interruptions
  • Loss of data
  • Unauthorized account access
  • Reliance on Website information
  • Third-party websites or services
  • Event changes or cancellations
  • Technical failures
  • User-submitted content

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

These Website Terms do not replace or modify any separate liability waiver, release, assumption-of-risk agreement, or other agreement applicable to participation in Shongum activities.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Shongum Sportsmen’s Association and its officers, directors, representatives, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful use of the Website
  • Your material violation of these Terms
  • Content you submit to the Website
  • Your infringement of another person’s intellectual-property or privacy rights
  • Fraudulent or unauthorized activity conducted through your account

This provision does not require indemnification to the extent prohibited by applicable law.

26. No Waiver

A failure by Shongum to enforce a provision of these Terms on one occasion does not waive Shongum’s right to enforce that provision or another provision later.

27. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable when permitted by law.

If it cannot be made enforceable, it will be severed from these Terms without affecting the validity of the remaining provisions.

28. Governing Law

These Terms and disputes concerning use of the Website will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable federal law controls.

To the extent permitted by law, legal proceedings concerning these Terms or use of the Website shall be brought in a court of competent jurisdiction in New Jersey.

This provision does not prevent Shongum from seeking appropriate injunctive or other relief in another jurisdiction when necessary to protect its property, systems, intellectual property, or legal rights.

29. Changes to These Terms

Shongum may revise these Terms periodically to reflect changes in:

  • Website functionality
  • Association operations
  • Online services
  • Technology providers
  • Legal requirements
  • Security practices
  • Association policies

The revised Terms will be posted on the Website with an updated effective date.

When appropriate, Shongum may provide additional notice of material changes through email, a member notice, the Website, or another reasonable method.

Continued use of the Website following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.

Where Shongum requires affirmative acceptance of revised Terms, continued access to particular Website functions may require that acceptance.

30. Entire Agreement Regarding Website Use

These Terms, together with the Shongum Privacy Policy and any transaction-specific or event-specific terms applicable to a particular Website activity, constitute the agreement between the user and Shongum concerning use of the Website.

These Terms do not constitute the entire agreement governing membership in Shongum or participation in Association activities.

Membership and activity participation remain subject to applicable Association governing documents, policies, rules, waivers, and procedures.
